Currently the 5th Circuit is entertaining an appeal to Judge Reed O'Connor's ruling that the entirety of Patient Protection and Affordable Care Act (PPACA or Obamacare) is unconstitutional. If the original ruling stands throughout an appeals process, what remedy would be implemented.
I cannot find what Texas sought as a remedy, nor how that remedy would be implemented.
For example, would policies purchased under the PPACA be invalidated? Would subsidies (paid to insurers for the benefit of policy holders) immediately stop?
Would insurers be relieved of the restrictions associated with pre-existing conditions for all policies?
So the top line question here is: What was the remedy sought and did the plantiffs (Texas) request a particular implementation.
