I purchased a home and paid the agreed earnest money. Living and traveling between two cities I don't remember how the money was paid (wire, cashier's check, money order. All parties (including buyer, seller, both representing realtors and both escrow attorneys) agreed that the earnest money was paid. The house closed without event and closing documents confirmed earnest money was paid. Fourteen months later the seller's real estate agent is claiming the earnest money was never paid. Seller's agent is seeing me for the failure to pay earnest money and demanding proof of payment. Debt collector is representing the plaintiff. Proof has not been presented for "failure to pay".
