  2. Could hosting in Tonga protect a "content-sharing" site from being shut down?

Copyright holders may sue infringers for damages (section 28), and wilful infringement is a crime punishable by a fine of up to TOP 20000 (currently around 9000 USD) and imprisonment for up to three years.
